General Terms and Conditions

Service Chauffeur Paris, whose registered office is located at 2 bis rue dupont de l'eure in Paris 75020, is a Limited Liability Company with a share capital of €7623. It is registered in the Trade and Companies Register under the number R.C.S 392 296 223 PARIS and holds a transport capacity issued by the Regional Equipment Directorate. The transport of passengers for consideration is regulated by decrees published in the Official Journal of the French Republic.

In France, only Passenger Cars with Driver driven by Professional Drivers holding the relevant Certificate of Competence and having the necessary qualification are authorised. Vehicles and authorised personnel are checked by the Prefectures to ensure this service.

The acceptance of our offers implies the knowledge and unconditional acceptance of these general terms and conditions of sale and this unless otherwise expressly agreed prior to our interventions

Article 1: Definition of the service:

The "customer" is any person (individual or professional acting on behalf of a company) making a reservation on the website www.servicechauffeur.com

Any beneficiary of the order is referred to as "the passenger".

The package includes the vehicle in working order, the driver with the required service skills, professional insurance for the people transported, fuel, kilometres and time according to estimate, departure and return garage (Paris 75020), options defined with the customer. Time and/or mileage are deducted from the departure and return of the vehicle to the garage, according to pricing (unless special conditions apply). Any charging unit (hour, kilometre) started is due. Our prices are exclusive of VAT (Excluding Taxes Not Included with a 10% VAT which would have to be updated in the event of a change by any legislative and/or regulatory provisions) and only expressed in EUROS. The package, unless otherwise specified on the order form, does not include the amount of tolls and parking, entrances to public places, telephone calls, meal and overnight stay allowances for the driver.

Article 2: Regulations :

For any reservation, a minimum deposit of 30% will be charged on the amount of the service requested. The balance of the payment, unless otherwise agreed by Service Chauffeur Paris, is made forty-eight hours before the service. In all cases, the customer of the requested service and signatory of the order form is solely responsible for its payment in the event of default by the user. According to the law n°92-1442 of 31 December 1992, all our services are payable in cash for individuals and companies. No discount is granted for payment at an earlier date. In the event of payment after the date shown on the invoice or receipt, default interest may not be less than 3 times the legal interest rate applied pro rata temporis.

After our acceptance, they can be made cash at the end of the service. For long-term services and for account customers, the payment of invoices may be subject to a different weekly or periodic payment stipulated in writing, sent at the end of the month of the performance date of the service(s) by e-mail and/or post to the address provided. Depending on the type of service, a deposit may also be required. Rates may be changed without notice (except for account customers and long-term services) Quotations issued by our sales department are valid for thirty days. By express agreement and unless postponed in time and accepted by us, failure to pay on a single due date will result in the payment of compensation equal to 15% of the sums due, plus legal interest and any legal costs. In the event of late payment, our company has the right to suspend or cancel pending service orders without prejudice to any other recourse.

Article 3: Withdrawal / Cancellation:

Any withdrawal by the customer of a reservation for any reason whatsoever shall result in the loss of the deposit as a lump sum and irreducible compensation. It must be sent at least 72 hours before the start date of the service by email to the Service Chauffeur Paris sales department, whose details can be found on the website www.servicechauffeur.com

Reservations cancelled on the day of the service before the vehicle leaves the garage, or the customer's absence at the time of pick-up, will be invoiced. Twenty-four hours before the service is to be provided, 50% of the service ordered will be invoiced.

Article 4: Non-availability

In the event that the lessor cannot provide the vehicle provided for in the contract, the sums already paid will be fully refunded without recourse or compensation for the damage caused. However, the deposit will be retained if both parties agree to make another vehicle available.

In the event of a breakdown or accident during the service rendering the vehicle unavailable, the amount of the service will be calculated pro rata to the time spent, without recourse or compensation for the damage caused.

Service Chauffeur Paris reserves the right to subcontract its services to listed companies.

Article 5: Remedies and compensation:

No recourse or compensation for damage caused in the event of vehicle delay (strikes, demonstrations, weather conditions, major traffic difficulties) can be accepted, unless both parties agree on an amicable settlement of the contract. In any event, in the event of damage due to delay, and in particular that caused by the lack of a flight, Service Chauffeur Paris will limit its liability to the amount of its transport package.

Article 6: Safety and damage:

The driver must respect the highway code and is prohibited from violating it (speed limit, prohibited direction, refusal of priority) even at the request of the passenger(s) even in case of extreme emergency.

In the event of damage to the interior equipment or other damage to the vehicle or other vehicles, for example when the doors are opened unexpectedly, the damage caused will be borne by the customer. The immobilisation of the vehicle will also be invoiced to you for a minimum amount of 150.00 € HT according to the category of vehicle if the repairs require a delay of more than one day.

For safety reasons, we ask you to please let the driver open and close the doors. Smoking is not allowed inside the vehicles. They are non-smokers in accordance with the law of 17 September 1977. The driver is instructed to stop to allow smokers to relax if they wish. In the event of drug use by the customer, the driver is instructed to immediately stop the current service. This decision will in no case entitle you to a refund of this service.

Animals are not allowed in our vehicles, unless prior agreement has been obtained and a cage or airtight container is provided for this purpose.

Article 7: Liability of the carrier

The carrier's liability is expressly excluded in the event of non-compliance by the customer with the transport regulations.
Financial penalties, criminal sanctions or material and physical damage caused to third parties or to the vehicle following either the negligence of the customer or user, their staff or guests, or orders given by the customer or user, their staff or their guests, to the driver despite the latter's warning, will be charged to the customer who will accept sole responsibility and assume the consequences, whatever they may be.
This applies in particular to valuables left in vehicles, damage to the interior and exterior of equipment, unintentional opening of doors, the number of passengers carried or the weight of the load exceeding the indications on the vehicle's registration document, route requirements that do not comply with the safety procedures in place, and requests of any kind that are contrary to French and Community regulations, particularly the Highway Code.

The volume of luggage transported is proportional to the capacity of the vehicle. Baggage is accepted up to a maximum of 20 kg per person transported and remains in the custody of the latter. We are not responsible for items left in our vehicles or elsewhere during the service.

The times indicated by our customer service where our drivers are provided only as an indication. In accordance with Article 133-2 of the French Commercial Code, delays caused on the routes cannot therefore give rise to any damage and interest, although our permanent aim is to regularly avoid this type of circumstance.

Article 8: Disputes:

Subject to all legal provisions, any dispute that may arise is, by express agreement, the exclusive competence of the Paris Commercial Court, or any other court at the sole discretion of Service Chauffeur Paris.

Article 9: Confidentiality:

Service Chauffeur Paris undertakes to respect the confidentiality of the personal data communicated by the Customer on this website in accordance with the French Data Protection Act No. 78-17 of 6 January 1978. As such, Service Chauffeur Paris undertakes not to disclose to third parties the personal information provided by the User on this website and to use it only for the processing of the reservation.

In accordance with French law and Freedom No. 78-17 of 6 January 1978, the Customer may exercise a right of access to his file and a right of rectification and/or deletion for information concerning him by sending his request to the customer service of Service Chauffeur Paris.
